By accessing or using APB OS ("Service") you agree to these Terms. If you do not agree, do not use the Service. These Terms are governed by the laws of New South Wales, Australia.
APB OS is a SaaS platform providing property pipeline management, feasibility analysis, portfolio reporting, and related tools for Australian property professionals. The Service is provided "as is" for business use.
You must be at least 18 years old and have authority to bind the company or entity you represent. The Service is intended for business use by Australian property professionals and is not a consumer product.
Each company workspace is a separate, isolated environment. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised access.
New workspaces receive a 14-day free trial with full access. After the trial, continued use requires a paid subscription at the rates published on the pricing page. Pricing is in Australian dollars (AUD) inclusive of GST where applicable. Subscriptions renew automatically unless cancelled before the renewal date.
You must not: use the Service for any unlawful purpose; attempt to gain unauthorised access to any account or system; transmit malware or harmful code; scrape or harvest data without written permission; resell or sublicense the Service without our written consent.
The calculations, reports, and analytics generated by the Service are for illustrative and decision-support purposes only. They do not constitute financial advice, investment advice, or tax advice. You should obtain independent professional advice before making investment decisions. Affinity Property Buyers Pty Ltd accepts no liability for decisions made in reliance on outputs from the Service.
Certain guarantees under Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law, "ACL") cannot be excluded. Nothing in these Terms excludes, restricts, or modifies those guarantees. Where permitted by law, our liability is limited to the cost of resupplying the Service or refunding the fees paid for the period in which the failure occurred.
To the maximum extent permitted by law, Affinity Property Buyers Pty Ltd is not liable for indirect, incidental, special, or consequential damages, or loss of data, profit, or goodwill, arising from or related to these Terms or the Service.
The Service and all content, code, and materials therein are owned by Affinity Property Buyers Pty Ltd or its licensors. You may not copy, modify, distribute, or create derivative works without our written permission. Your data remains your property; you grant us a licence to process it solely to provide the Service.
Either party may terminate at any time. We may suspend or terminate your account immediately if you breach these Terms. On termination, your data will be retained for 30 days and then deleted unless required by law.
Disputes should first be raised with us at support@affinitypropertybuyers.com.au. If not resolved within 30 days, either party may refer the matter to mediation. Unresolved disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
We may update these Terms at any time. We will notify active subscribers via email or in-app notice. Continued use after the effective date of changes constitutes acceptance.
